About POGO's Federal Contractor Misconduct Database (FCMD)
The government awards contracts to companies with histories of misconduct such as contract fraud and environmental, ethics, and labor violations. In the absence of a centralized federal database listing instances of misconduct, the Project On Government Oversight (POGO) is providing such data. We believe that it will lead to improved contracting decisions and public access to information about how the government spends hundreds of billions of taxpayer money each year on goods and services. Evergreen International Aviation consists of a portfolio of five aviation companies headquartered in McMinnville, Oregon. Evergreen consists of an international cargo airline that owns and operates a fleet of Boeing 747s, an aircraft maintenance, repair, and overhaul facility, a full-service helicopter company, an aircraft ground handling company, and an aircraft sales and leasing company. In addition, Evergreen owns and operates Evergreen Agricultural Enterprises.

1. Banc of America Breach of Contract
Banc of America Securities LLC sued Evergreen International Aviation for breach of contract and quantum meruit (restitution based on unjust enrichment) arising out of agreements in which Banc of America agreed to act as Evergreen’s financial agent in exchange for the payment of certain fees. 2. Fraud and Breach of Contract
On February 11, 2003, Tridair Repair and Manufacturing, Inc. filed a complaint against Evergreen International Aviation, Inc. “alleging fraud and breach of contract”. “On May 6, 2005, the parties entered into a Settlement Agreement and Release whereby each party agreed to dismiss all claims, with prejudice, in exchange for the release of such party’s equipment and property held by the other party."... more»
