About POGO's Federal Contractor Misconduct Database (FCMD)
The government awards contracts to companies with histories of misconduct such as contract fraud and environmental, ethics, and labor violations. In the absence of a centralized federal database listing instances of misconduct, the Project On Government Oversight (POGO) is providing such data. We believe that it will lead to improved contracting decisions and public access to information about how the government spends hundreds of billions of taxpayer money each year on goods and services. The Shaw Group Inc. is a provider of technology, engineering, procurement, construction, maintenance, manufacturing, consulting, and facilities management services for government and private sector clients in the energy, chemical, environmental, and emergency response markets. The Shaw Group won several contracts to assist in the post-Hurricane Katrina recovery. Headquartered in Baton Rouge, Louisiana, the Shaw Group has over $4 billion in annual revenues and employs approximately 22,000 people in offices and operations on four continents. In 2012, the Shaw Group merged with Chicago Bridge & Iron (CB&I) to become CB&I Shaw.

Instances of Misconduct
1. TVA Whistleblower Retaliation
The U.S. Department of Labor Administrative Review Board ruled that Shaw Group subsidiary Stone & Webster Construction broke federal whistleblower protection law when it fired James Speegle, a painter foreman at the Tennessee Valley Authority’s Browns Ferry Nuclear Plant, in May 2004. Speegle was fired after he raised concerns about what he thought were serious problems with the protective paint coatings being applied to the plant’s cooling systems. In September 2010, the U.S. Nuclear Regulatory Commission (NRC) ordered Shaw Group to institute improvements in its whistleblower protection and workplace safety policies and practices throughout its nuclear operations.... more»
2. Loan Agreement Liability
During fiscal year 2005, the U.S. District Court in Delaware rendered a judgment against the Shaw Group and in favor of Saudi American Bank for $6.7 million. Saudi American Bank claimed that, as part of the acquisition of Stone & Webster in July 2000, the Shaw Group had assumed the estate company’s liability under a loan agreement and guarantee. 3. Gibson, et al. v. Shaw Group Inc, et al. (Racial Discrimination)
Three former employees of Shaw subsidiary Shaw Process Fabricators, Inc. filed a lawsuit in federal court in Louisiana alleging racial discrimination. In August 2001, the parties agreed to settle this case and a similar case involving another plaintiff pending in state court for an undisclosed amount.... more»
4. Contract Fraud at TVA Nuclear Plants
The Shaw Group’s Stone & Webster Construction subsidiary agreed to pay the federal government $6.2 million to end a contract fraud investigation related to work at Tennessee Valley Authority (TVA) nuclear plants in East Tennessee and Alabama. Stone & Webster has a 10-year, $1 billion dollar-plus contract to provide modification and maintenance services for the TVA, the nation's largest public utility. The government alleged that during the period from 2003 through 2006, Stone & Webster failed to maintain required logs and provided false reports to TVA that misclassified and understated the number and severity of employee injuries in support of its claims for safety-related performance fees.... more»
