Synopsis: The county of Santa Clara, California and a number of federally-funded county medical facilities sued GlaxoSmithKline, Wyeth and other pharmaceutical companies claiming the companies overcharged them in violation of pricing agreements the companies had with the Secretary of Health and Human Services, which required that manufacturers charge a price for covered outpatient drugs that will not exceed the Average Manufacturer Price (“AMP”) decreased by a rebate percentage. The plaintiff facilities allege they were overcharged for prescription and over-the-counter drugs and pharmaceutical products.
