About POGO's Federal Contractor Misconduct Database (FCMD)
The government awards contracts to companies with histories of misconduct such as contract fraud and environmental, ethics, and labor violations. In the absence of a centralized federal database listing instances of misconduct, the Project On Government Oversight (POGO) is providing such data. We believe that it will lead to improved contracting decisions and public access to information about how the government spends hundreds of billions of taxpayer money each year on goods and services. Misconduct Type: Labor
Enforcement Agency: NRC
Contracting Party: None
Court Type: Administrative
Amount: $35,000
Disposition: Fine
Synopsis: The Nuclear Regulatory Commission (NRC) proposed a $35,000 civil penalty against power generation company Babcock & Wilcox for waiting more than two hours to declare an emergency during an incident involving uranium at its Lynchburg, Va., facility in July 2009. According to the NRC, the company did not declare an alert emergency until more than two hours after workers discovered that a saw used to cut fuel components discharged oil containing a small amount of highly enriched uranium into a container. The NRC identified three other violations but because of actions taken by Babcock & Wilcox to correct them, the NRC did not propose civil penalties for those violations. Babcock & Wilcox is a subsidiary of McDermott International Inc.
