About POGO's Federal Contractor Misconduct Database (FCMD)
The government awards contracts to companies with histories of misconduct such as contract fraud and environmental, ethics, and labor violations. In the absence of a centralized federal database listing instances of misconduct, the Project On Government Oversight (POGO) is providing such data. We believe that it will lead to improved contracting decisions and public access to information about how the government spends hundreds of billions of taxpayer money each year on goods and services. Synopsis: The Knolls Atomic Power Laboratory in upstate New York is managed under a contract with the Department of Energy by KAPL, Inc., a company owned by Lockheed Martin. In 1996, a KAPL downsizing resulted in the layoffs of 31 workers, all but one of whom were 40 years old or older. The former employees, including Clifford Meacham, filed a lawsuit under the Age Discrimination in Employment Act (ADEA). A federal jury found in favor of the plaintiffs in 2000 and awarded them nearly $6 million in damages, but the verdict was reversed on appeal. After a second round of appeals, the case is currently before the U.S. Court of Appeals for the Second Circuit for further review.
