Davis v. Lockheed Martin (Defective F-35 Joint Strike Fighter Software)
Sylvester Davis, a former Lockheed Martin software engineer, filed a False Claims Act lawsuit alleging that the software produced by Lockheed Martin for the F-35 Joint Strike Fighter (JSF) and other programs was not developed and tested in accordance with the required safety standards. In August 2010 the court dismissed Davis’ suit, ruling that he failed to present evidence of specific acts of Lockheed or its employees engaging in making false claims. The court later vacated this ruling and allowed Davis’ False Claims Act claims to proceed.
