Winston et al. v. Academi Training Center (Whistleblower Retaliation)

Former Academi employees Robert Winston and Allen Wheeler claim that they were fired from their jobs in Afghanistan after reporting a colleague’s attempts to falsify the results of firearms proficiency tests. Winston and Wheeler also claim the company tried to prevent them from getting jobs with other private security contractors. Under the Worldwide Personal Protective Services (WPPS) contract, the State Department requires Academi to periodically test and provide certification of employees’ firearms proficiency. Winston and Wheeler claim that in March 2012, their supervisor instructed them to help him fabricate firearms qualification scores. After they were fired, Winston and Wheeler claim Academi caused the State Department to put their names on a “Do Not Use” list, which precludes them from obtaining State Department contracts in the private security industry.
