New Hampshire MTBE Pollution Lawsuit
The state of New Hampshire filed a lawsuit in state court against 22 oil companies, including Shell Oil Company, for using the chemical methyl tertiary butyl ether (MTBE), a gasoline additive the state alleges has caused widespread contamination of the state’s waters and has adverse health effects. The state claims that the companies produced a defective product, created a public nuisance and violated state environmental and consumer protection laws. In November 2012, it was announced that Shell and three other companies agreed to pay $35 million to settle the lawsuit.
