“Gardening Club” Air Freight Cartel Investigation
The European Commission fined 14 freight forwarding companies, including UPS and two subsidiaries of Agility Public Warehousing Co. KSC, a total of €169 million (US$225 million) for operating an air freight cartel on routes between Europe, the United States, China, and Hong Kong from 2002 to 2007. The Commission alleged the companies had coordinated their prices and surcharges for door-to-door air freight forwarding services, using the names of vegetables as code words to conceal their collusion. UPS and two subsidiaries were fined a total of €9.8 million (US$13 million); Agility’s subsidiaries were fined €5 million (US$6.6 million).
