Tuten v. United Airlines (USERRA Claims)

A lawsuit was filed against United Airlines on behalf of a class of 1,160 United pilots who served in the military from 2000 to 2010 and who did not receive their pension contributions required by the Uniformed Services Employment and Reemployment Rights Act (USERRA). The plaintiffs alleged that, from 2000 to 2010, United failed to make the legally required contributions to the pilots’ pension plan while they took leave to serve in the military. The lawsuit settled for $6.15 million.
