HIV/AIDS Mail-Order Medications Lawsuit
United Healthcare settled a class action lawsuit in which customers with HIV or AIDS objected to being forced to use an in-house mail-order service, instead of local pharmacies, to purchase HIV/AIDS medications. The plaintiffs claimed United Healthcare, OptumRX Inc., Pacificare Life & Health Insurance Company, and UnitedHealth Group required enrollees to purchase their medications from a mail-order pharmacy or pay thousands of dollars or more each month for their medications. The lawsuit alleged the policy was discriminatory because United Healthcare did not have a similar requirement for patients purchasing other medications. Under the settlement, United Healthcare will allow patients with HIV or AIDS to opt out of a requirement that they obtain their medications by mail-order and use in-network retail pharmacies.
