National Women’s Law Center v. Battelle Memorial Institute (Sex Discrimination)
The National Women’s Law Center (NWLC) filed a complaint with the U.S. Department of Health and Human Services’ Office for Civil Rights against five health care institutions, including Battelle Memorial Institute, alleging that they violated the Affordable Care Act (ACA) by failing to provide maternity coverage to dependents of its employees. The ACA bars sex discrimination in health care programs that receive federal funds. The law requires that plans provide comprehensive coverage to women, including full coverage for gynecological and maternity care, on the same terms as other benefits. NWLC alleged that Battelle’s 2013 employee health plan specifically excludes from coverage maternity benefits to any child or dependent of employees except for those that are enrolled as a dependent of an employee who works and/or resides in Massachusetts. In January 2017, it was announced that four institutions, including Battelle, had ended their discriminatory policies.
