False Reimbursement Claims for Massachusetts Environmental Cleanup

Chevron USA, Inc. and Texaco Downstream Properties, Inc. (which merged in 2001) agreed to pay $1.7 million to resolve allegations that they received reimbursement from a state environmental cleanup fund even though had also received payments from insurers for the same cleanup sites. The alleged violations involved cleanup projects at gasoline stations throughout Massachusetts. Under the state’s Underground Storage Tank Petroleum Product Cleanup Fund program (UST Fund), claimants must disclose if they sought reimbursement from another source, including insurance, for expenses they submit to the UST Fund. The settlement resolved the alleged failure of both companies before the merger—and Chevron after the merger—to disclose to the UST Fund that they had certain insurance policies and that Chevron and Texaco each received payments from their respective insurers through policy buy-backs and/or settlements of their claims.
