Johnson et al. v. CCA (Kentucky Overtime Lawsuit)
Employees at the Marion Adjustment Center and Otter Creek Correctional Facility in Kentucky allege that, since 2007, Corrections Corporation of America forced them to work extra hours and denied them overtime pay and meal and rest breaks, in violation of the Fair Labor Standards Act and Kentucky wage laws. Shift supervisors and assistant supervisors claim they do uncompensated work before and after regular shift hours, including traveling between units at the prison, staying on post while waiting for a replacement officer to arrive, and attending training sessions on days off. CCA classifies the affected positions as exempt from federal and state overtime requirements.
