Schuett v. FedEx (Denial of Same-Sex Survivor Benefits)

Stacey Schuett, the widow of FedEx employee Lesly Taboada-Hall, sued FedEx for refusing to provide spousal pension benefits because both spouses are women, in violation of Employee Retirement Income Security Act of 1974 (ERISA). At the time of Taboada-Hall’s death, she had been an employee of FedEx for more than 26 years and was fully vested in her pension. FedEx refused to provide the benefits because its pension plan incorporates the federal Defense of Marriage Act, which was partially struck down by the United States Supreme Court in 2013. The case was settled in July 2016.
