Idaho Average Wholesale Price Lawsuit
SmithKline Beecham Corp. (d/b/a GlaxoSmithKline) agreed to pay $2.6 million to resolve Idaho’s claims relating to the “average wholesale prices” reported by the company. The settlement was intended to reimburse taxpayers for the state’s share of the excessive prices Idaho Medicaid paid for GSK’s prescription drugs as a result of inflated average wholesale price reporting. The state alleged, for example, that GSK reported an average wholesale price for its antidepressant Wellbutrin that was inflated by 27 percent. The company admitted no liability or wrongdoing.
