Flonase Antitrust Litigation

Drug wholesalers filed a class-action lawsuit accusing GlaxoSmithKline of improperly impeding the marketing of a generic version of its Flonase nasal spray. The plaintiffs alleged that Glaxo unlawfully abused the citizen petition process of the Food, Drug, and Cosmetic Act by fraudulently delaying the introduction of generic – and thus cheaper – versions of Flonase into the American market. By doing so, the plaintiffs alleged, Glaxo illegally maintained monopoly power for 20 months between 2004 and 2006 and overcharged purchasers of Flonase by millions of dollars. In November 2012, Glaxo agreed to settle the lawsuit for $150 million.
