Mendoza v. Health Net of California (Denial of Coverage)
Robert Mendoza and Kalana Penner filed a lawsuit alleging Health Net’s denial of their medical insurance claims violated state law. Mendoza and Penner had severe medical conditions that required surgical treatment. Both plaintiffs’ treating physicians recommended a specific procedure for which Health Net denied coverage on the basis that they were not medically necessary. The plaintiffs claim that Health Net’s criteria for medical necessity contravene the standards set forth by California law.
