Boles v. Merck (Fosamax Products Liability)
Shirley Boles claimed that she developed osteonecrosis of the jaw as a result of using Merck’s Fosamax osteoporosis drug from 1997 to 2006. In June 2010, a federal jury found that Fosamax was defectively designed and awarded Boles $8 million in damages, which the judge later reduced to $1.5 million. In September 2012, before a retrial on the damages issue, the parties agreed to a confidential final damage award.
