Guo v. Novartis (Whistleblower Retaliation)
Min Amy Guo, a former executive at Novartis, claimed that she was fired for raising objections to a proposed study of Novartis’ breast cancer drug Afinitor. Guo raised concerns that the study, to be performed by McKesson Corporation, was too expensive, would violate internal procedures governing third-party studies, and would present a conflict of interest. In February 2019, a jury awarded Guo $1.8 million in damages on her state whistleblower retaliation claim. The jury awarded Novartis over $345,000 on the company’s counterclaim of unjust enrichment.
