Mackey, et al. v. Fluor (False Claims, Whistleblower Retaliation)
Rickey Mackey, Baldemar Mercado, and Goldie Byrd worked for Fluor Intercontinental on the U.S. Army’s Logistics Civil Augmentation Program (LOGCAP) IV contract in Afghanistan from 2012 to 2014. The plaintiffs claim that Fluor retaliated against them for reporting the company’s alleged violations of the Federal Acquisition Regulations and abuses in managing government property. They claim that the company engaged in a scheme to manipulate property reports for the purpose of concealing lost government property worth millions of dollars. They allege that Fluor retaliated against them with threats, harassment, discrimination, and, ultimately, termination of their employment, in violation of the False Claims Act.
