Bautista v. Valero Energy Corporation (Unfair Business Practices)

Plaintiffs in a California class-action lawsuit accused Valero and its CST Brands subsidiary of unfair business practices for charging customers who pay for gasoline with debit cards the higher credit price rather than the lower advertised cash price. The plaintiffs claimed the practice of advertising a lower cash price but charging debit card users the higher credit price was misleading because a reasonable consumer believes that a debit card is the equivalent of cash. In September 2020 Valero settled the lawsuit, agreeing to pay up to $1.65 million for attorney fees and expenses and to change its signage at gas stations to include debit card prices along with cash and credit prices.
