Clark v. Bamberger, et al. (Wrongful Death)
Rolls-Royce and L-3 Communications (as parent company of Army Fleet Support LLC) settled a lawsuit filed by the widow of Jeremy Clark, a civilian flight instructor killed in a Kiowa OH-58 helicopter crash at Fort Rucker, Alabama, in December 2010. The lawsuit alleged the crash was caused by the failure of a system known as the Full Authority Digital Electronic Control, or FADEC, and the defendants’ failure to properly inspect, service, maintain, and repair the helicopter, its engine, and its component parts. Pursuant to the settlement agreement, the defendants paid a total of $8.5 million and denied all liability and responsibility for the accident and Clark’s death.
