Nester, et al. v. Textron, et al. (Defective Utility Vehicle)

Virginia Nester was seriously injured by a Textron E-Z-GO Workhorse utility vehicle. Nester was using the vehicle to transport cattle feed on her ranch. When she got out of the vehicle to open a gate, a bag of feed tipped over and caused the vehicle to accelerate forward and run her over. A jury found that the vehicle was defectively designed and unreasonably dangerous, and that the defect was the proximate cause of her injuries. However, the jury found Nester 50 percent responsible for her injuries. She and her family were awarded $7.9 million in damages.
