Misconduct in Patent Lawsuit

A federal judge found that Merck committed misconduct in a patent infringement lawsuit against Gilead Sciences involving the Sovaldi hepatitis C treatment drug. The judge found “a pervasive pattern of misconduct by Merck and its agents” and “numerous unconscionable acts,” most of which involved Merck’s interactions with Sovaldi’s inventor, Pharmasset. The judge found that Merck lied to Pharmasset, misused Pharmasset’s confidential information, breached confidentiality and firewall agreements, and lied under oath at deposition and trial. The judge overturned the judgment and the jury’s award of damages to Merck.
