U.S. ex rel. Derrick v. Hoffman-La Roche et al. (Kickbacks, False Claims, Whistleblower Retaliation)

Crystal Derrick, a former employee at Roche Diagnostics Corp., alleged that in 2013 Roche forgave millions of dollars in rebate overpayments owed by Humana in exchange for Humana placing Roche’s products on Humana’s Medicare Advantage drug formularies, in violation of the Anti-Kickback Statute and False Claims Act. Derrick also claimed that Roche fired her for reporting the alleged unlawful conduct. In February 2021, Roche and Humana agreed to pay $12.5 million to settle the lawsuit.
