Illegal Denial of Mental Health and Substance Abuse Coverage
A federal court in California ruled that UnitedHealth Group subsidiary United Behavioral Health (UBH) illegally denied mental health and substance use disorder coverage to thousands of patients. The court found that UBH used flawed and overly-restrictive internal guidelines in denying coverage claims, and in so doing violated its fiduciary obligations under the Employee Retirement Income Security Act (ERISA), as well the laws of Connecticut, Illinois, Rhode Island and Texas. In November 2020, the court ordered UBH to reprocess an estimated 67,000 claims for coverage that previously were denied.
