Restricting Competition on Emissions Cleaning Technology

The European Commission (EC) issued a statement of objections to three automakers, including Daimler, informing them of its preliminary view that they breached European Union antitrust rules from 2006 to 2014 by colluding to restrict competition on the development of technology to clean the emissions of petrol and diesel passenger cars sold in Europe. The EC found that the companies’ behavior aimed at restricting competition on innovation for two emission cleaning technologies, and in doing so denied consumers the opportunity to buy less polluting cars. The companies will have an opportunity to respond in writing to the EC’s statement of objections and request an oral hearing. If the EC concludes there is sufficient evidence of an infringement, it can adopt a decision prohibiting the conduct and imposing a fine of up to 10% of the company’s annual worldwide turnover.
