U.S. ex rel. Perri v. Novartis Pharmaceuticals (Retaliatory Dismissal)
Former Novartis Pharmaceuticals employee Joseph Perri alleges he was fired in retaliation for expressing concerns that the way Novartis provided commercial discounts on the multiple sclerosis drug Gilenya to Express Scripts in exchange for Medicare Part D business violated the False Claims Act and the Anti-Kickback Statute. Perri, who was Novartis’ account director for Express Scripts at the time, alleges that Novartis directed him to carry out the allegedly illegal practice, and that the company offered him severance pay and other benefits if he agreed to drop his claims.
