Vancouver Alumni Asset Holdings v. Daimler AG (Diesel Emissions Securities Litigation)
A group of shareholders alleged that Daimler programmed the BlueTEC diesel technology in some vehicles made by its Mercedes-Benz unit to perform significantly more cleanly during emissions testing than during regular driving. The shareholders claimed that although the BlueTEC vehicles emit nitrogen oxides at levels many times higher than U.S. law allows, Daimler marketed the cars as “clean diesel,” and that by hiding its alleged emissions testing defeat devices it artificially inflated the price of its stock. Daimler settled the lawsuit for $19 million.
