César Castillo LLC v. Pfizer et al. (Delay of Generic Lipitor)
A proposed class action lawsuit against Pfizer alleges drug wholesalers overpaid billions of dollars for the cholesterol drug Lipitor because of an unlawful scheme to stifle generic competition. The lawsuit alleges a “reverse payment” arrangement in which Pfizer paid pharmaceutical company Ranbaxy to delay launching its generic version of Lipitor, forcing direct purchasers to pay for brand-name atorvastatin calcium longer than necessary (over a year and a half after the expiration of Pfizer’s patent).
