Illinois Average Wholesale Price Litigation

Dozens of drug manufacturers—including Johnson & Johnson and its subsidiaries Janssen Pharmaceutical Products, Ortho Biotech Products, and McNeil-PPC—paid the state of Illinois $678 million in settlements to resolve claims relating to the marketing and selling of prescription drugs and the manufacturers’ reporting of average wholesale price. The state alleged that the drug companies had published inflated prices for prescription drugs, causing the overpayment of millions of dollars in drug costs. J&J’s share of the settlement totaled $49.5 million.
