U.S. ex rel. Respiratory Care LLC v. Respironics (Respiratory Device False Claims and Kickbacks)

Philips RS North America LLC, formerly known as Respironics Inc., paid $25.3 million to resolve False Claims Act and Anti-Kickback Statute allegations that it misled federal health care programs by paying kickbacks to durable medical equipment suppliers. From 2014 to 2020, Respironics allegedly caused suppliers to submit claims for ventilators, oxygen concentrators, CPAP and BiPAP machines, and other respiratory-related medical equipment that were false because Respironics provided illegal inducements to the suppliers in the form of free physician prescribing data.
