RCRA and False Claims Act Violations at Paducah Gaseous Diffusion Plant
In August 2003, the Department of Justice filed complaints in partial intervention in two False Claims Act lawsuits against Lockheed Martin (U.S. ex rel. Natural Resources Defense Council, et al v. Lockheed Martin Corporation, et al, and U.S. ex rel. Tillson v. Lockheed Martin Energy Systems, Inc., et al. — both cases were joined in 2004). The lawsuits alleged that Lockheed violated the Resource Conservation and Recovery Act (RCRA) at the Paducah Gaseous Diffusion Plant by not properly handling, storing, and transporting hazardous waste, and that Lockheed violated the False Claims Act by misleading Department of Energy officials and state regulators about the nature and extent of environmental noncompliance at the plant. In February 2016, it was announced that Lockheed agreed to pay $5 million to settle the lawsuits: $4 million to resolve the False Claims Act allegations, and $1 million in RCRA civil penalties. Lockheed did not admit any liability or wrongdoing.
