Fiser v. Dell (Breach of Contract)
Robert Fiser filed a class-action lawsuit against Dell in New Mexico after buying a Dell computer online in 2003 that he alleges came with less memory than had been promised on the web site. His lawsuit includes claims of breach of contract, breach of express and implied warranty, unjust enrichment, unfair trade practices and false advertising. The New Mexico Court of Appeals ordered Fiser’s case to go to arbitration as an individual lawsuit based on provisions contained in the terms and conditions in Fiser’s purchase agreement, but in June 2008 the state Supreme Court ruled that the arbitration provision was invalid.
